But he notes that there's already "pretty strong circumstantial evidence in the case".

The driver believed to be responsible for Sunday's crash on Interstate 70 in Indianapolis had been deported twice in the last decade.

"We are disheartened that ghoulish and inappropriate public commentary has politicized this tragedy". He was charged Wednesday with four felony counts.

The family of Atlanta-native Edwin Jackson is showing appreciation for the outpouring of support they've received since the Indianapolis Colts player was killed by a drunk driver on Sunday. Mr. Trump tweeted Tuesday morning.

Trump's tweet also noted the need for tighter border security to limit illegal immigration. He said his client has claimed he was not driving the vehicle.

The case has gained attention from President Donald Trump and others in the immigration debate. Authorities say he has been deported twice. The two more serious counts each carry a maximum sentence of 20 years in prison.

An Indiana prosecutor blasted President Donald Trump on Wednesday for politicizing the case of an immigrant illegally living in the US and charged in a drunken crash that killed Indianapolis Colts linebacker Edwin Jackson and another man, saying his and others' comments were "ghoulish and inappropriate". Orrego-Savala, who was driving a Ford F-150 truck, drove onto the emergency shoulder and hit the rear of the vehicle, striking both Jackson and Monroe, with one of the bodies landing in the center lane of I-70, according to the police. Indianapolis television station WRTV reported that Orrego-Savala told the judge through an interpreter: "I wasn't driving the vehicle".

Jackson and the driver of his ride-share auto were killed after a black Ford F-150 pickup driven by a 37-year-old man struck both of them as they were standing on the side of a highway by their stopped vehicle.

The office of Marion County prosecutor Terry Curry filed the charges Wednesday.

Manuel Orrego-Savala, a 37-year-old Guatemalan national, was charged with illegal re-entry of a previously deported alien.

Before the crash on Sunday morning, Monroe had pulled his 2018 Lincoln to the side of Interstate 70 in Indianapolis because Jackson had become ill, according to state police.

The immigration charges will remain pending until the state case is concluded, federal prosecutors say. He faces up to 10 years in prison on that charge, which the USA attorney's office said would be handled after any state charges are resolved. He was arrested shortly after the fatal crash.

"We have got to be able to enforce who comes in and out of our country", said Rokita. Federal prosecutors spell his name as Orrego-Zavala, but the federal criminal compliant lists "Orrego-Savala" as among his aliases.

An immigrant who was living illegally in IN when he was arrested in a suspected drunken-driving crash that killed Indianapolis Colts linebacker Edwin Jackson and another man faces a court hearing. He tried to flee the scene but was arrested by a responding officer on a nearby exit ramp, according to Indiana State Police. They say Jackson and Monroe were struck and killed by a pickup truck driven by Orrego-Savala.

Orrego-Savala was taken to the Marion County Jail, accused of driving without a license and on suspicion of intoxicated driving.
