Federal Bureau of Investigation hacking suspect Lauri Love wins appeal against extradition to US

Love, 32, has Asperger's syndrome and a depressive illness. If Love had been tried in the United States he would have faced 99 years in prison.

Lauri Love (33), a United Kingdom activist, was charged in 2013 with serious cybercrimes against the US Army, NASA and many other federal agencies.

The US has 14 days to lodge their grounds for appealing the decision to Britain's Supreme Court, according to Love's lawyers.

Speaking outside of court after the verdict, Love said he hopes the ruling would set a precedent.

"With any luck, today's ruling will mean that prosecuting authorities finally start respecting the clear will of the British public: we do not extradite our geeks to face medieval punishment in the United States", Colvin said in a statement.

Love has been the focus of media attention before. The worldwide cyberattack by the WannaCry ransomware cryptoworm targeted computers running the Microsoft Windows operating system in 150 countries, and caused extensive damage to UK's National Health Service computer system.

He has been charged in three US states: New Jersey, New York and Virginia.

Peter Caldwell, representing the USA, made submissions inviting the judges to dismiss Love's appeal. May said he was seriously ill and extradition would violate his human rights.

For his part, Fitzgerald, on behalf of Love, previously told the court: "On a pragmatic level, the very fact of being taken away from England exposes him to a high risk of suicide". Formally known as section 83A of the Extradition Act 2003, the forum bar sets out seven tests that judges must consider when deciding whether to extradite someone overseas to stand trial outside the UK.

As Home Secretary Theresa May blocked the extradition of Gary McKinnon, another hacker suffering Asperger's syndrome and depression who was judged to be a suicide risk. As we have pointed out, the CPS did not intervene to say that prosecution in England was inappropriate.

Ian Norris was extradited in 2010 after a drawn-out appeals process. Local courts did not file any charges at the time.

Supporters argued that the systems infiltrated in #OpLastResort had publicly known vulnerabilities and that rather than doing "real harm", the bulk of costs were incurred by bringing protections up "up to the standard of security that they should have been in the first place".

His extradition was ordered by British Home Secretary Amber Rudd in November previous year after he was unable to persuade a judge that he should be tried in the UK.

"The judges felt that the District Judge leaned too heavily on testimony to the effect that no prisoner commits suicide while on suicide watch, the USA prison's term for 24/7 monitoring of at-risk inmates".

Babar Ahmad was extradited in 2012 on charges of supporting terrorism through a website he set up in 1996.
