Judges revolt against Chief Justice, government to not intervene

Chief Justice India

Asked whether he felt that the judges should not have come out in the open with their grievances against the Chief Justice, he said: "Any problem, everyone can see two sides".

The letter said that there have been instances where cases having "far reaching consequences for the nation" and the institution have been assigned by the chief justices of this court "selectively to the benches "of their preference" without any rationale basis" for such assignment.

Regarding the turn of events, Jose feels that more or less the mainstream media and the main opposition parties who were silent on the The Caravan expose were now forced to take up the issue. "We will write a letter to the government for the same, but it is not that big a matter to be brought in public", the Bar Council of India chairman added.

Without taking any name, BCI chairperson Manan Kumar Mishra said, "No political party or leader should take an undue advantage of the situation arising out of the press conference of the four senior Supreme Court judges". Today's press conference would cause a bad precedent.

"It is too well settled in the jurisprudence of this country that the chief justice is only first amongst the equals - nothing more or nothing less". And many judges believe the answer is yes.

"Whatever differences judges have over roster or allocation of cases, should be resolved by in-house mechanism without airing views in public", he said.

They said the issue should not be politicised and the dignity of the institution of the Supreme Court be maintained.

"Administration of the Supreme Court is not in order".

"This is the saddest day for Indian judiciary and Indian democracy..." A unanimous resolution passed by the SCBA on Saturday said, "All PIL matters including the pending PIL matters should be either taken up by the Honourable Chief Justice of India, or if he has to assign to any other Bench, it should be assigned to the judges in the Collegium".

While the ruling party has tried to steer clear on any controversy relating to the matter, Congress President addressed a full-fledged press conference on Friday evening expressing his fear over the sword hanging on India's democratic system and demanded a proper investigation into the death of Judge Brij Gopal Loya.

A day after four Supreme Court judges publicly raised questions on the functioning of the office of the Chief Justice of India, efforts to forge a consensus between them have not yielded any results. "But if they had to come to a press conference that they should have said something substantial and just creating the doubts in the minds of the people will not serve the interest of the judiciary". "We hope they won't allow the issue to escalate", Venugopal said here. However, there's no confirmation on whether CJI Misra will indeed be meeting with the rebel judges.

Meanwhile, highly placed sources in the government said that since it was an internal matter of the judiciary, the government had no say in it and did not wish to interfere.
