Uber Sex Assault Class Action Filed by 2 Women

Uber must make drastic changes to prevent another female rider from harm.

A lawsuit filed this week in court in San Francisco alleges that "thousands" of female Uber passengers have been subject to rape, sexual assault, and other forms of "gender-motivated harassment" by the company's drivers since 2010. The lawsuit argues that Uber's lax background check policies allow unsafe individuals to get jobs driving for the company, and thus get access to potential victims.

The complaint filed by the two plaintiffs accuses Uber of engaging in "unlawful" and "fraudulent" conduct by misrepresenting the safety of its ride-hailing service.

The complaint notes how MA had initiated a stricter review of potential Uber drivers.

"Uber has done everything possible to continue using low-priced, woefully inadequate background checks on drivers and has failed to monitor drivers for any violent or inappropriate conduct after they are hired", the complaint states, according to USA Today.

Last week, John David Sanchez, 52, a former Uber driver who raped one passenger and sexually assaulted more than 12 women was sentenced to 80 years and 4 months in jail.

Bustle has reached out to Uber for comment.

Uber should be required to implement stricter and more thorough screenings of potential drivers, provide insurance coverage for riders, and monitor drivers who go off route or turn off the app during a ride, according to the lawsuit. Jane Doe 2 alleges that an Uber driver "forced her to engage in intercourse against her will" after following her into her home.

The suit further alleged that as a way of protecting itself from requirements that a transportation company would be required to fulfill, Uber instead has called itself a technology platform thus giving it the ability to avoid regulations that govern drivers for limousine or taxi companies.

"This is no longer an issue of "rogue" drivers who act unlawfully", reads the suit.

"A litany of incidents regarding sexual assaults, and physical assaults, by Uber drivers on passengers, shows a pattern of similarly heinous, but avoidable attacks", the lawsuit states. Uber has attempted to publicly boost its reputation through a recent donation to sexual assault and domestic violence prevention programs. It remains unclear exactly what that training includes, specifically as it relates to Uber drivers.
